Derzeit läuft vor dem IGH das Streitverfahren zwischen den USA und dem Iran. Rechtsgrundlage ist ein Freundschaftsvertrag mit dem Iran aus dem Jahr 1955, der bis heute überlebt hat. Die USA bestreiten die Zuständigkeit des Gerichts aber. Der US-Vertreter hat dabei ein schönes Zitat von Gerald Fitzmaurice vorgelesen, das wohl für alle internationalen Streitfälle passt:
„nothing undermines confidence in the process of international adjudication so quickly and completely as the feeling that international tribunals may assume jurisdiction in cases not really covered by the intended scope of the consents given by the parties.“
